Welcome to Neighbourly.co.nz, a website and mobile phone application that allows you to connect with other users in your neighbourhood (Neighbourly). This agreement describes your rights and responsibilities as a user of Neighbourly and as a Neighbourly.co.nz member (Member) and what you can expect from us.
You agree that we will send service notifications and community notices from Neighbourly and on behalf of our partners to you in the following ways: (1) within the Neighbourly private messaging account, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). If you do not agree to having a private messaging account or providing us your contact information for these purposes, we will not be able to provide you with a Neighbourly account. Please review your settings to control and limit other email communications or mobile text messages you receive from us.
Registration, Eligibility and Address Verification:
Neighbourly member Content should not be reproduced in any way outside of the member's own community without the express permission of the member who has published and/or owns the Content. This includes text, photos, videos and otherwise.
However, whenever you upload Content on publicly-viewable screens or pages, that information will be publicly available to those persons as determined by you in your Neighbourly settings and can be collected and used by others. We cannot control who reads your Content or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your Content.
Remember: you should only share the sort of things you feel comfortable sharing with your neighbours over the fence.
We take care to protect the rights of all users of Neighbourly and we expect that our Members will do the same. You must ensure that you abide by our Neighbourhood Guidelines (or any other Member Guidelines posted by us) at all times.
We may monitor your use and the use of other members of Neighbourly to ensure that your and any other Member's conduct is in accordance with Neighbourly Guidelines for Neighbourly Behaviour (Neighbourly Guidelines) and is not Inappropriate Conduct.
Inappropriate Conduct may include:
We use search filters and other search technology for monitoring with a view to limiting Inappropriate Conduct and communications between Members. We do not guarantee that our filters will be able to find all instances where there may be Inappropriate Conduct and Communications between Members. You must ensure that your own conduct is within the Neighbourly Guidelines.
You understand that, where you allow a third party to use your Neighbourly login, we will deem this to be your conduct and you will be responsible for that conduct.
Where we determine that there has been a breach of the Neighbourly Guidelines or there has been Inappropriate Conduct, we may terminate your Neighbourly Membership in our sole discretion and report this breach to the relevant law enforcement agency.
Should you become aware of any breach of the Neighbourly Guidelines, Inappropriate Conduct or members whom you know may harm a Neighbourly neighbourhood, please let us know so that we may review and, where we consider appropriate, take action.
Where you apply to be and where you are accepted as a Neighbourly Lead, you agree to the following terms and conditions:
Where you sign up to receive email communication or mobile text messages from Neighbourly we may continue to provide this information to you until you indicate otherwise. You may opt out of receiving email communication at any time by altering your email settings contained within your Member profile or using the unsubscribe link in the footer of all emails.
You must ensure that any username and password you have as a Member is kept secure and confidential and not revealed to any other person. Any use of Neighbourly (including posting content, communicating with others or changing your account settings, etc.) using your Member Account will be deemed to be your use. You agree to notify us immediately of any unauthorised use of your username and/or password or any other breach of security. Upon your notification we will cease to rely on that username and password.
As no data transmission over the Internet can be guaranteed to be completely secure, we cannot ensure or warrant the security of any information you transmit or receive through the Neighbourly. These activities are conducted at your own risk.
You agree to indemnify and hold us and our officers and employees harmless from any claims, actions, costs (including legal costs) or losses by us or any third party due to or arising out of:
Neighbourly is provided on an "as is" and "as available" basis, therefore, use is at your own risk. You acknowledge and agree that, to the extent permitted by law, we make no warranties:
You or we may terminate this agreement at any time. Without limiting the foregoing, we have the right to immediately terminate any Member accounts in the event of any conduct by the Member which we, in our sole discretion, consider to be unacceptable, or in the event of a failure by the Member to comply with any of these Terms.
These Terms are governed by and will be construed in accordance with the laws of New Zealand and you submit to the jurisdiction of the courts of New Zealand.

Information Collected by Neighbourly
We collect various pieces of information about Members and users of Neighbourly. This information includes:
Your name and street name will be displayed at all times when you use Neighbourly and alongside any Content posted by you.
We give you the option of making other information about yourself publicly available. You can control who sees Content you post (e.g. specific persons, a group, only your Neighbourhood, Nearby Neighbourhoods) through your Neighbourly settings.
Information you Choose to Provide
Whenever you voluntarily disclose personal information on publicly-viewable screens or pages, that information will be publicly available to those persons as determined by you in your Neighbourly settings, and can be collected and used by others. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. Please ensure you are familiar with the Using Social Networks Safely tips. Remember: you should only share the sort of things you feel comfortable sharing with your neighbours over the fence.
You may also (but are not required to) provide information about yourself (such as your gender, location, URL, or a biography). Any additional image or information you provide may be publicly displayed.
If you sign in using your Facebook login, you authorise us to access certain Facebook account information, including information about your Facebook friends. By allowing us to access your Facebook account, you understand that we will obtain and share your name and a profile picture.
How Neighbourly Uses Your Information
Your personal information will only be used for the purposes of your online activity on Neighbourly and Neighbourly-supported features, unless you otherwise provide us with your consent.
We may use your personal information to provide and improve our services, make special offers, customise services, better understand you as a user, diagnose and fix problems and sell and display offer and advertisements that may be of interest to you.
We may (in our sole discretion) also use your information to monitor your use of Neighbourly (including through search filters and other search technology) for what we consider is Inappropriate Conduct or conduct that is not in line with our Neighbourly Guidelines. We may use this information to contact you or any other Member where we consider there has been a breach of the Neighbourly Guidelines by you or where another Member of Neighbourly has breached the Neighbourly Guidelines and this breach affects you. Where we consider it is appropriate, we may also disclose this information to the relevant law enforcement agency.
Except as set out in Address Verification and Disclosure of Your Information to Others set out below, we do not provide your exact address, email address or phone number to any third party unless you give us consent to do so.
Your address must be verified before Member registration can be completed. We will use your name and address of residence provided on the Member registration page to verify your address. This may include Neighbourly acting as your agent to verify your identity electronically using the details entered by proving those details to NZTA, a credit reporting agency, or other entities solely for verifying my identity

Tracking and Targeting Policy
Neighbourly collects data about your browsing activity on our website. We may also use non-personal information that we collect about you on our network to identify you on third party websites where we have an arrangement in place to serve ads on those third party websites. We may also collect anonymous internet usage data from third parties.
One of the reasons we collect usage data is to display targeted advertisements or content on our website and also on third party websites. For that purpose, usage data is collected and assigned to one or more pre-defined categories (for example "holiday seekers"). If this infers a particular interest, a cookie is placed in your web browser which may determine the type of targeted advertising or content that you receive. We target advertisements and content in order to improve your user experience - so that you are served advertisements and content that we believe may be more relevant or useful to you.

Third party advertisers purchase advertising products from us that enable them to target particular types of users of our website, for advertisements served both on our network and also on third party websites.
In some cases we permit advertisers to embed their own cookies in advertisements subject to our standard advertising terms and conditions. Generally, advertisers will embed cookies in advertisements to monitor the performance of their advertising campaign, but they may also collect anonymous usage data relating to browsing activity on our network.
"Third party" or "third parties", as referred to throughout this policy, means a Neighbourly entity or organisation that is engaged in OBA and collects and uses web viewing behaviour data for the purposes of OBA via our website.
"Third Party OBA" occurs when browsing behavior off our network is used to deliver behavioural advertisements on our network.
We adhere to industry "best practice" for the storage of anonymous usage data. Security firewall, data encryption, and authorisation access are used to safeguard data held by us.
We use Adobe Audience Manager ("AAM") technology and cookies to serve interest based advertising. AAM offers consumers the opportunity to select a persistent opt-out cookie to prevent information from being uniquely associated with their browsers. This way, a user can opt out of AAM cookies without erasing or altering other cookies associated with a browser. To opt out of AAM cookies, you can go to http://www.adobe.com/privacy/opt-out.html#4 , and click on the 'Opt Out' button.
Opting-out means that the display advertising you see on our network may not be tailored to your interests or preferences on the web browser you are using. Anonymous usage data may, however, continue to be collected by us for other purposes (including those outlined above).

Content Providers and Partners
Where Neighbourly contains links to other sites, these websites may not follow the same privacy policies as us. We recommend that you check any relevant privacy policies before providing your personal information to any third party.
How Neighbourly Holds Your Information
Any personal information that you provide to us will be collected and held by us at Cider Building, 4 Williamson Avenue, Grey Lynn, Auckland 1021, New Zealand. Under the Privacy Act 1993 you have rights of access to and correction of personal information that we hold.
Should you request to have your Neighbourly account deleted, we will retain your personal information for a period of 90 days just in case any issues arise in relation to inappropriate conduct. At the end of this period we will delete your personal information unless you ask us to do otherwise.
Correcting and Updating Your Information
Although we take reasonable steps to ensure that all data we use is accurate, we depend on our users to update or correct their personal information whenever necessary. We offer the ability for users to correct or change their personal information online at any time and as often as necessary.

Neighbourly Guidelines for Neighbourly Behaviour
We created Neighbourly because we all want to be part of communities we are proud of. And we believe that a neighbourhood is one of the most important and useful communities in an individual's life.
We believe neighbours should want to look out for each other, and ultimately be neighbourly!
To us being Neighbourly means:

Supporting your neighbourhood
Being a good neighbour / Neighbourly conduct
Bullying, name-calling, harassment, offensive language, threats, breaching the privacy of another member, spamming or discrimination of any kind is considered un-Neighbourly and will not be tolerated.
Any photos, comments and/or any other material deemed unproductive or offensive by a Neighbourhood Lead or the Neighbourly team will be removed at our discretion.
Breaching the Guidelines for Neighbourly Behaviour may result in your Neighbourly account being temporarily or permanently deactivated.

If you feel you are in an unsafe situation please contact your local police station or dial 111 if an emergency arises before contacting the Neighbourly team.
Advertising Terms and Conditions
Neighbourly Limited place material for publication on behalf of the customer (you) subject to the Stuff Limited terms and conditions of advertising (Terms). These Terms apply to all or websites and other digital services (Digital Advertising) unless we have agreed other terms in writing with you.
